Introduction

The online education platform, ClassYab, provides a learning environment where students can reserve online classes with their preferred instructors at their desired time by reviewing resumes, ratings, and feedback from other students. Additionally, instructors can conduct online classes in their area of expertise and at their preferred time to generate income.
This agreement between ClassYab as the provider of the online class hosting platform and users (account holders, including students and instructors) is binding. ClassYab may implement changes to its policies at any time, which will be communicated to its users and will always be visible in this section. The use of the ClassYab platform implies acceptance of these terms.

Registration and user account

Users are required to provide accurate personal information, including name, surname, email address, and mobile number, at the time of registration. Failure to provide accurate information or any discrepancies will result in ClassYab not being responsible for providing timely and appropriate support. Users are obligated to keep their username and password confidential and not to disclose their account information to others. If a student attempts to disrupt or interfere by creating multiple user accounts, their account will be deleted without prior notice, and all legal consequences will be the responsibility of the student.

Dispute resolution law

This agreement is governed by the laws and regulations of the Islamic Republic of Iran. Any dispute regarding it, including disputes between instructors and students with ClassYab, such as disputes related to the conclusion, validity, interpretation, termination, breach, and enforcement thereof, shall be referred to the Disciplinary Council of the Computer Guild Organization of the province for arbitration. The decision of the provincial disciplinary council is final and binding. The arbitration clause herein shall be considered as an independent agreement regardless of the main contract and the invalidity or termination of the original agreement shall not affect its validity.

Force majeure cases

All terms and conditions stated are enforceable under normal circumstances, and in the event of any force majeure, ClassYab platform shall not be liable for any of the aforementioned laws.

Copyright

All content on the website is solely owned by the ClassYab platform and is subject to the protections provided in domestic and international intellectual property laws. Furthermore, none of the contents of the ClassYab website can be reproduced, copied, sold, or otherwise exploited for commercial and non-commercial purposes. Any unauthorized reproduction for commercial and non-commercial purposes without written permission from ClassYab is prohibited and will be legally pursued.
This Terms and Conditions page constitutes an agreement that, pursuant to Article 10 of the Civil Code of the Islamic Republic of Iran, is considered a legal and enforceable contract. All users and individuals who use the ClassYab platform in any way or by any means are subject to this agreement.

Method and location of class

All classes must be held on the ClassYab platform. Holding classes outside of ClassYab, even with payment of commission fees, except in special cases with the support's notification, is unauthorized and may result in cash penalties and instructor profile suspension.
For better interaction with students, instructors are required to keep their camera on throughout the class. If an instructor is unable to turn on the camera, the payment will be refunded to the student's account, and no amount will be paid to the instructor for that session.
To maintain focus and create a suitable learning environment, instructors must hold their online classes in a well-lit and noise-free location. Additionally, the instructor's background should be a wall or a bookshelf.
Instructors are obligated to present themselves with appropriate cultural and ethical attire in the class. Failure to comply with the instructor's profile will be suspended, and the wallet balance will be recorded as a penalty, which will be pursued through legal channels.
Smoking during class time is strictly prohibited as a sign of respect to the students. In case of violation, the instructor's profile will be suspended.
The quality control expert of the ClassYab educational platform has the authority to monitor all classes.
Instructors are required to participate in sessions coordinated by the education unit.
The relationship between the instructor and the student must be within the framework of the educational environment. Any contact that violates the personal privacy of the instructor or the student will result in permanent suspension of the violator's profile and, depending on the decision of the educational committee, may result in cash penalties and legal action.
Any disrespect or humiliation (verbal, written, etc.) from the instructor towards the students, supporters, or others will be investigated by the disciplinary committee, and appropriate action will be taken against the violator. In addition, a cash penalty will be imposed on the instructor, and serious violations will be pursued through legal channels.
Instructors must provide their identity information accurately and completely (such as contact number, personal information, educational information, work experience, biography text, etc.). In case of instructor's dishonesty in providing information, the instructor's account will be suspended and subject to cash penalties. Furthermore, ClassYab will pursue this matter through legal channels.
The instructor's attire in the introduction video and profile picture must comply with cultural and ethical standards. Otherwise, the education unit reserves the right to suspend instructor registration or block the instructor's profile at any stage.
Instructors are considered trustees of students' information. If an instructor discloses students' confidential identity information, educational information, etc., the instructor is considered a violator, and the instructor's account will be suspended by ClassYab. The matter will also be pursued through legal channels.

Instructors can choose their own rules with a flexible or strict approach according to their discretion.

It is possible to reschedule the class time up to 12 hours without penalty. Otherwise, you must cancel the class and reserve another one.
If the class time is rescheduled, canceling the class is not possible.

presence and absence

Instructor is obliged to be present in the class at the scheduled time and for the specified duration. If the instructor fails to attend the class, a penalty will be deducted from the instructor and negative points will be considered for the instructor.
If a student does not attend the class within 10 minutes after the class starts, the instructor must inform the support unit about the student's delay and must wait in the class until the reason for the delay is followed up and the result is announced. (If the instructor fails to inform, a commission penalty will be considered and negative points will be considered for the instructor.)

Amount contract and payment method

Considering that students are introduced to instructors through the ClassYab platform, 25% of the class fee will be allocated to the 'Platform Usage Fee (Commission)' to the ClassYab organization.
The instructor can only withdraw funds from their wallet twice a month.
Withdrawal requests will be processed and transferred to the registered account within a minimum of 48 working hours after the withdrawal request is submitted.
The registered account in the user's account must be in the name of the instructor, and transferring the teaching fee to another person's account is not possible.
The instructor can receive all the balance of the classes held, which has been confirmed by the student.
Immediately after the end of the class, a class confirmation form will be sent to the student, and after confirming the class, the class fee will be added to the instructor's wallet after deducting the commission. If the class is not confirmed after 48 hours, the system will automatically confirm the class and add the teaching fee to the instructor's wallet after deducting the commission.
If a student expresses dissatisfaction with the class after its completion, the class status will be changed to 'Arbitration', and the Education and Quality Control team will inform the instructor and the student of the result after reviewing. Meanwhile, the class fee will remain as a deposit in the custody of ClassYab.
Any purchase and sale of goods (notes, books, etc.) is prohibited, and in case of violation report, the instructor's profile will be blocked and pursued through legal channels.
The maximum amount for the class fee section will be determined by the supervisor, and up to 20% increase in price per month is possible with the supervisor's approval.

legal deductions

Both parties are responsible for declaring and paying their respective taxes for all their independent economic activities. The platform complies fully with the country's asset, tax, and insurance laws regarding its brokerage activities, and the instructor complies fully with the laws regarding their teaching services. The platform bears no responsibility for how the counterpart reports their taxes.
As the 'instructor' provides their teaching services independently and without any direct economic or managerial control, the present contract and cooperation framework between the 'Platform' and the 'Instructor' will not be subject to labor and social security laws.

termination contract

Each party to the contract may terminate the contract with prior notice. The instructor is obliged to inform the platform of their decision to leave the platform at least one week in advance.
In any case, termination of the contract does not relieve either party of responsibility for previous teachings, and failure to fulfill commitments creates liability for the defaulting party.

The method and location of holding the class

In case of any technical issues from the student's side (such as internet disconnection, sound issues, etc.), the class organizer holds no responsibility for refund or arranging a replacement class; therefore, before entering the class, please check the quality and speed of your internet and ensure the functionality of your system, camera, microphone, etc.
To maintain focus and create a suitable learning environment, it is necessary to choose a well-lit and quiet place to participate in the online class.
Adding another person to the private class is against the rules, and if you join the class with another person, that session will be canceled, and the cost will be forfeited.
Recording the class without permission from the instructor is against the rules, and the instructor and class organizer can pursue this matter through legal channels.

Booking, Rescheduling, and Cancelling Classes

Before selecting a class, review the approach of the desired instructor. In general, instructors can choose a flexible or strict approach, so the cancellation rules will be applied according to the approach of your desired instructor.

Moving the class time up to 12 hours before class time is possible without penalty. Otherwise, you must cancel the class and reserve another one.
In case of rescheduling the class time, canceling the class is not possible.

Presence and absence

Students are required to attend the class at the scheduled time. In case of delay, the cost of the class is forfeited, and the instructor bears no responsibility for compensation, delay, or arranging a replacement class for the student.
If a student reserves a non-free session (trial/private), the cost of that session will not be refunded.
If the instructor does not show up in the class after 10 minutes from the scheduled time, the student is obligated to inform the delay to the support unit of the platform and wait in the class until the reason for the delay is investigated and the outcome is communicated. Otherwise, the cost of that session will not be refunded to the student's wallet.

Amount contract and payment method

All payments must be made through the ClassYab payment gateway. Otherwise, ClassYab will not be able to provide services, and it will not bear any responsibility for payments made outside the ClassYab payment gateway.
Requests for withdrawing funds from the student's wallet are processed on weekdays during office hours.
Withdrawn funds will only be deposited into the card number used for the payment.
All classes must be held on the ClassYab platform. Holding classes outside of ClassYab, except in special cases announced through the website, is not allowed, and the violator will be dealt with according to the regulations of the violation procedure.
